Terms of Service
Last updated: 19 March 2026. These Terms of Service ("Terms") govern your access to and use of the Exportlab platform ("Service"). By creating an account or using the Service, you agree to be bound by these Terms, the Privacy Policy, the Cookie Policy, and, where applicable, the Data Processing Addendum ("DPA"). If you do not agree to these Terms, you may not use the Service.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have the legal authority to enter into this agreement on behalf of yourself or your organization. If you are under 18 (or the age of majority in your jurisdiction), you must not use the Service.
These Terms may be updated from time to time. Material changes will be communicated via email or within the Service. Continued use of the Service after updates constitutes acceptance.
2. Description of Service
Exportlab provides a cloud-based platform for managing, organizing, sharing, and delivering media content, including photos, videos, galleries, and related collaboration features.
The Service may include real-time features delivered via WebSocket connections. Real-time connectivity is not guaranteed and may be affected by network conditions.
Any new features introduced to the Service will also be subject to these Terms.
3. Accounts, Credentials, and Security
To access certain features, you must create an account.
You agree to provide accurate and up-to-date information, maintain and promptly update your account information, and authorize Exportlab to retrieve information from identity providers (Google, Apple, etc.) if used during login.
You are responsible for safeguarding your login credentials, API keys, and access tokens. Report any unauthorized access to hey@exportlab.io immediately. You may not share your account or access accounts belonging to others.
4. Acceptable Use Policy
You agree not to misuse the Service. Prohibited behavior includes, but is not limited to:
- Unlawful Use: Illegal activities or promoting illegal actions.
- Prohibited Content: Harmful, violent, hateful, harassing, discriminatory, pornographic, or otherwise objectionable content. Strictly prohibited: any content involving minors in sexual contexts.
- Intellectual Property Violations: Uploading content you do not own or lack rights to use.
- Security Violations: Malware, phishing, bots, scraping, harmful code, unauthorized access to systems, servers, APIs, or networks, or attempting to bypass, overload, or disrupt the Service.
- Sensitive Data: Uploading highly sensitive or regulated data unless Exportlab provides explicit secure mechanisms for such data.
Exportlab may investigate violations and may remove content, suspend accounts, or notify law enforcement when necessary.
5. User Content, License, and AI-Generated Metadata
You retain ownership of all content you upload ("User Content").
By uploading content, you grant Exportlab a non-exclusive, worldwide, royalty-free license to store, process, transmit, display, and create technical copies of your content solely for the purpose of operating, maintaining, and improving the Service.
If you enable AI features, the Service may generate metadata such as captions, keywords, categories, and summaries derived from your content. Unless otherwise required by law, you own your User Content and the AI-generated metadata derived from it, and you grant Exportlab the rights needed to provide the Service.
AI-generated outputs are provided "as is" and may be inaccurate or incomplete. You are responsible for reviewing and verifying AI-generated results before relying on them.
You are responsible for ensuring you have the necessary rights to upload and share your content. Exportlab may remove content but is not obligated to monitor it. You may encounter content from others that you find objectionable; Exportlab is not liable for such content.
Feedback you provide may be used freely, and all intellectual property rights in feedback transfer to Exportlab.
6. AI Features
AI-powered features are optional and user-initiated. When enabled, media content may be transmitted to third-party AI providers (including OpenAI and AWS) to generate captions, keywords, classifications, scene descriptions, or similar metadata.
AI indexing may consume token credits as described below. If you choose not to enable AI features, your media will not be processed by these providers.
Exportlab may provide an AI assistant for trial or plan recommendations. Assistant conversations are stored temporarily (up to 30 days) for operational purposes.
7. Biometric Data and Face Recognition
The Service offers an optional face recognition feature powered by AWS Rekognition. When activated, biometric identifiers (face embeddings) may be created and stored to match faces across photos.
You must not enable face recognition unless you have obtained all legally required consents from individuals depicted in your content. You are solely responsible for compliance with biometric privacy laws in your jurisdiction (including consent, notice, and retention obligations).
Face recognition is an opt-in feature requiring explicit activation. Biometric data is stored until you delete it or close your account.
You agree to indemnify and hold Exportlab harmless from claims arising from your use of biometric features or your failure to obtain required consent.
8. Integrations and Plugins
Exportlab may provide integrations or plugins (including plugins for DaVinci Resolve or Adobe Lightroom) that connect to the Service via API keys.
Plugins are licensed, not sold. You may use them solely to access the Service for your internal business purposes, and you may not reverse engineer, redistribute, or modify them except as permitted by law.
You are responsible for safeguarding API keys used by plugins or integrations. Exportlab may revoke keys for suspected abuse or security risks.
Exportlab does not warrant compatibility of plugins with future versions of third-party software. Plugins are governed by these Terms.
9. External API / Developer Access
Exportlab may provide a public API for select plans. API access is subject to rate limits and usage policies communicated within the Service or documentation.
You are responsible for all activity performed using your API keys. You must secure your keys and ensure downstream systems comply with applicable data protection laws.
Exportlab may suspend or revoke API access for abuse, excessive usage, security incidents, or violations of these Terms. No service-level guarantees are provided unless expressly stated in writing.
10. Guest Upload Events
The Service may allow you to create guest upload events that permit third parties to upload content via shared links.
You are solely responsible for ensuring that guests have the necessary rights to upload the content they submit and for providing any required privacy notices to guests.
Guest email addresses, if collected for verification or confirmation, are processed solely to facilitate the upload and provide transactional notifications.
Event passes or other paid add-ons may be offered for guest uploads. Unless required by law, such purchases are non-refundable once access is provided.
Exportlab is not responsible for content uploaded by guests. Such content is subject to the same content rules and removal policies as User Content.
11. Client Portal
You may invite your clients to access specific galleries or projects through the Client Portal. Clients receive their own credentials and can access only the content you share with them.
You are the controller of your clients' personal data. You must have a lawful basis to provide client information to Exportlab and to grant them access.
Client accounts are tied to your account and will be terminated if your account is closed.
12. Team Collaboration and Messaging
Team collaboration features may include invitations, shared workspaces, and messaging.
Messages and collaboration data are stored on Exportlab servers. Team administrators may access team content. Messages are retained until deleted or the account is closed.
Exportlab does not provide end-to-end encryption for team messages.
13. Contracts and Documents
If the Service provides document or contract template features, Exportlab is not a party to any contract between you and your clients and does not provide legal advice.
You are responsible for ensuring the legal validity of any documents you create, send, or sign through the Service, including compliance with applicable electronic signature laws.
14. Token Credits
Token credits are a consumable add-on used for AI indexing. Tokens are separate from subscription plans and may be purchased in packs.
Tokens are consumed when AI indexing is performed. Consumed tokens are non-refundable. If AI processing fails, tokens may be automatically refunded.
If your token balance reaches zero, AI indexing will be unavailable until you purchase additional tokens. There is no automatic replenishment unless you enable it explicitly.
15. Storage Limits and Fair Usage
Subscription plans include storage and bandwidth limits that vary by tier. Photo and video storage may be tracked separately.
Trial plans include additional per-upload limits. Storage enforcement may include warnings, temporary upload blocks, or other restrictions.
The Service is not intended as a general backup system or mass-public CDN. Exportlab may throttle, limit, or suspend usage, charge additional fees for excessive usage, or terminate accounts showing abnormal or abusive activity.
16. Payment, Billing, and Subscriptions
Exportlab offers free trials and paid subscription plans. You agree to provide a valid payment method, pay fees when due, and accept applicable taxes.
Payments are processed via Stripe. Fees are typically non-refundable unless required by law or explicitly communicated.
Subscriptions renew automatically and can be canceled at any time before renewal. Downgrades may reduce available features, and failed payments may cause suspension or deletion of the account.
17. Data Protection and DPA
Your use of the Service is subject to the Exportlab Privacy Policy, Cookie Policy, and, where applicable, the Data Processing Addendum (DPA).
For business customers subject to GDPR or similar laws, Exportlab makes a DPA available upon request. The DPA governs Exportlab's role as a data processor when you upload personal data about others.
Exportlab processes and stores data primarily within the EU and may use reputable third-party providers for hosting, AI processing, or email delivery.
18. Data Portability and Account Deletion
You may export your data or request assistance with data portability by contacting hey@exportlab.io.
When you close your account, Exportlab will delete or de-identify your data within a reasonable period, subject to legal or billing retention requirements and backup cycles. Certain records (for example, invoices or audit logs) may be retained for legally required periods.
19. Exportlab Intellectual Property
All software, branding, designs, features, and materials - except User Content - are owned by Exportlab or licensed to Exportlab.
You receive a limited, non-transferable, revocable license to use the Service solely in accordance with these Terms.
Links to third-party services are governed by their own policies.
20. Copyright Infringement (DMCA / Notice-and-Takedown)
If you believe that content uploaded to Exportlab infringes your intellectual property, notify us at hey@exportlab.io.
Your notice must include:
- Work description: A description of the copyrighted work.
- Infringing content: Identification of the allegedly infringing content.
- Contact details: Contact information for follow-up.
- Good-faith statement: A statement that the use is unauthorized.
- Accuracy statement: A statement made under penalty of perjury regarding the accuracy of the notice.
- Signature: A physical or digital signature.
21. Termination and Suspension
You may close your account at any time.
Exportlab may suspend or terminate your account if you violate these Terms, create legal or security risks, fail to pay subscription fees, or if the Service is discontinued.
Upon termination, your right to use the Service ends, your content may be deleted, and Exportlab is not responsible for data loss. Client Portal access tied to your account will be terminated.
22. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind.
Exportlab does not guarantee uninterrupted service, error-free operation, accuracy of data, compatibility with your hardware, or security against all threats. You use Exportlab at your own risk.
23. Limitation of Liability
To the fullest extent permitted by law, Exportlab is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
Exportlab is not liable for loss of data, profits, revenue, or goodwill.
Exportlab's total liability is limited to the amount you paid in the last 12 months, or fifty (50) euros if you have paid nothing.
24. Indemnification
You agree to indemnify and defend Exportlab against all claims, damages, and expenses arising out of your use of the Service, your User Content, violations of these Terms, or infringement of third-party rights, including claims relating to biometric data or consent.
25. Governing Law and Jurisdiction
These Terms are governed by the laws of Germany.
All disputes shall be resolved before the courts of Munich, Germany, unless mandatory laws require otherwise.
26. Changes to the Terms
Exportlab may update these Terms at any time.
Material changes will be communicated via email or inside the Service, and continued use constitutes acceptance of the updated Terms.
27. Miscellaneous
These Terms constitute the entire agreement between you and Exportlab.
If any provision is unenforceable, the rest remains valid.
You may not assign rights or obligations without Exportlab's prior consent, while Exportlab may assign these Terms freely.
Exportlab is not liable for failures caused by events beyond reasonable control (force majeure).
Notices will be provided electronically.

29. Reserved Subdomains and Naming Restrictions
Exportlab may reserve, restrict, or reclaim certain subdomains, identifiers, usernames, or other naming elements at any time, including but not limited to system-related, administrative, security-related, legally sensitive, previously assigned, or future service-related names ("Reserved Names").
You acknowledge and agree that:
- Availability: Not all subdomains or identifiers are available for registration, even if they appear to be technically unassigned.
- Conflicts: Exportlab may deny, suspend, modify, or reassign a subdomain or identifier if it conflicts with internal systems, technical requirements, security considerations, legal obligations, branding, or future product features.
- Future Reserved Names: Exportlab may introduce new Reserved Names at any time without prior notice.
- Reassignment: If a subdomain or identifier assigned to you is later deemed a Reserved Name, Exportlab may require you to change it or may reassign or disable it and will make reasonable efforts to notify you and, where feasible, provide an alternative.
- Liability: Exportlab shall not be liable for any loss, disruption, or damages arising from the restriction, modification, or reassignment of subdomains or identifiers, regardless of whether a subdomain or identifier was previously approved, registered, or in active use.
