Exportlab is a platform where photographers, videographers, studios and their clients store, share and deliver their own content. We respect the rights of creators and expect our users to do the same. Content that infringes copyright or other third-party rights is not allowed under our Terms of Service.
This page explains how to report infringing content, how we handle reports, and how affected users can respond. It serves as our notice mechanism under the EU Digital Services Act (Art. 16 DSA) and as our notice-and-takedown procedure under the US Digital Millennium Copyright Act (17 U.S.C. § 512).
1. Reporting content
Send your notice to hey@exportlab.io with the subject "Copyright notice". To act on it, we need:
- your name and contact details (address, email, phone) — and, if you act for a rights holder, on whose behalf;
- a description of the work claimed to be infringed (a list, if several);
- the exact location of the content on Exportlab, ideally the full link (e.g. to the gallery, video or public page);
- a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on its behalf;
- your physical or electronic signature (a typed name is sufficient).
We usually cannot process notices without this information. Please note that knowingly submitting false notices may result in liability.
2. What we do
- We acknowledge receipt and review the notice promptly.
- If the notice is complete and the infringement sufficiently shown, we disable access to or remove the content.
- We inform the user who provided the content of the action, the reason and the option to file a counter-notice. We share the reporting party's contact details only as far as necessary for the procedure.
- Every case is documented internally.
Much of the content on Exportlab belongs to clients of an Exportlab user and is not public. If you know the user (e.g. your photographer), resolving it directly is often fastest.
3. Counter-notice
If your content was disabled or removed and you believe this was a mistake (for example because you own the rights or have permission), send a counter-notice to hey@exportlab.io with the subject "Counter-notice" and:
- your name, address, email and phone number;
- identification of the removed content and where it appeared before;
- a statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification;
- your consent to the jurisdiction of the federal district court for your address (or, if outside the US, any judicial district in which Exportlab may be found) and that you will accept service of process from the reporting party;
- your signature.
We forward the counter-notice to the reporting party. If they do not file a lawsuit within 10 to 14 business days, we may restore the content. Under the Digital Services Act you may also use our internal complaint process: simply reply to our notification.
4. Repeat infringers
We disable or terminate, in appropriate circumstances, accounts that repeatedly provide infringing content. We take into account the number and severity of cases as well as counter-notices.
